3. Design Services
By hiring Noelgraphy LLC, you agree to the following:
- A detailed project scope and cost will be provided before work begins.
- Revisions are limited as per the chosen pricing package.
- Final files will be delivered in agreed formats (e.g., JPG, PNG, PDF, AI, PSD).
- Any additional work beyond the agreed scope may incur extra fees.
4. Payment Terms
- A deposit or full upfront payment may be required before design work begins.
- Payment methods accepted: bank transfer, PayPal, or any other method agreed upon.
- Final deliverables will only be released upon full payment.
Late payments may result in delayed delivery and/or service suspension.
5. Intellectual Property Rights
- All original designs created by Noelgraphy LLC remain our property until full payment is received.
- Upon full payment, clients receive full rights to use the final approved design for commercial or personal use.
- Noelgraphy LLC reserves the right to showcase completed work in its portfolio or for marketing purposes, unless a non-disclosure agreement (NDA) is signed.
6. Refunds and Cancellations
- Deposits are non-refundable once work has started.
- If the client cancels a project after work has begun, partial payment may be retained to cover time and resources spent.
- In rare cases of client dissatisfaction, we will make reasonable efforts to revise the design.
7. Turnaround Time
Turnaround times are estimated and may vary depending on project complexity, client communication, and workload. We strive to meet deadlines but are not liable for delays caused by third-party issues or lack of client response.
8. Client Responsibilities
Clients agree to:
- Provide timely feedback, content, and approvals.
- Ensure all information submitted (such as brand materials, instructions, etc.) is accurate and legally theirs to use.
- Not hold Noelgraphy LLC liable for content submitted that infringes on third-party rights.
9. Limitation of Liability
Noelgraphy LLC is not liable for:
- Any indirect or consequential loss related to the use of our services
- Loss of profit, revenue, data, or goodwill
- Design misuse by third parties once delivered
10. Third-Party Tools & Content
If any third-party fonts, images, or assets are used, proper licenses will be obtained or guidance will be provided to the client to purchase them. Clients are responsible for ensuring continued usage rights.
11. Changes to Terms
We reserve the right to update or modify these terms at any time. Changes will be posted on this page with a revised effective date. Continued use of our services implies agreement to the updated terms.
12. Governing Law
These terms are governed by and construed in accordance with the laws of the State of Florida, United States.
